Terms and Conditions
These Terms and Conditions (hereinafter referred to as the "Terms") set forth the conditions of optional tours (hereinafter referred to as the "Service") offered on this website by Land Ace Co., Ltd. (hereinafter referred to as the "Company"), operator of Merry Japan Tours. All users (hereinafter referred to as "Customers") are required to adhere to these Terms when using the Service.
Article 1 (Application)
These Terms shall apply to all relationships between Customers and the Company relating to the use of the Service.
Article 2 (Responsibility of the Company)
The Company shall make reasonable efforts to ensure the accuracy of the information provided in relation to the Service. The Company is the provider of the Service and the contracting party with Customers, and shall provide the Service in accordance with the schedule requested by Customers, unless prevented by circumstances beyond its reasonable control.
Article 3 (Responsibility of Customers)
Customers shall use the Service in accordance with these Terms. Customers confirm that all information provided to the Company, including but not limited to the number of participants, desired tour duration and dates, name, e-mail address, telephone number, and hotel name, is true and accurate.
Article 4 (Fees, Method of Payment, and Billing)
Sales Price
The price of the Service is listed for each optional tour on the website. Unless otherwise specified, all prices are quoted in Japanese yen and include consumption tax (10%).
Fees Not Included
The price of the Service does not include Customers' transportation costs or entrance fees to sightseeing spots during the itinerary. Meals and transportation expenses for guides are borne by the Company and are not chargeable to Customers.
Method of Payment
The Company uses online payment services provided by a third party. Customers shall pay by credit card through the service, which is subject to the terms of use of the third-party provider.
Billing
After a reservation is made and a tour guide is assigned, the Company will send Customers an email. If there are any discrepancies, errors, or omissions in the reservation, Customers must contact the Company immediately.
Article 5 (Cancellation of Contract)
Cancellation by Customers
Cancellations must be made by contacting the Company via email at: merryjapantours@gmail.com.
Cancellation by the Company
The Company may cancel the Service in the following cases, with notice to Customers by email or orally:
- In the event of an earthquake, war, or other emergency, or where transportation services are suspended, making it impossible to safely and smoothly provide the Service.
- In the event of severe weather conditions (e.g., typhoons, thunderstorms) that prevent safe guidance to the destination.
Article 6 (Cancellation Charges)
Cancellation by Customers
A cancellation fee will be charged as follows, based on the scheduled date of the Service:
- 2 weeks to 4 days prior: 50% of the sales price
- 3 days to 1 day prior: 80% of the sales price
- Same day or no-show: 100% of the sales price
The effective date of cancellation is the date on which the Company receives notice of cancellation.
Cancellation by the Company
If the Company cancels the Service by the day before due to force majeure, such as bad weather or other circumstances beyond its control, the Company will refund 100% of the sales price (all remittance fees borne by the Company). However, if weather conditions worsen during the Service and the Company deems it necessary to cancel part or all of the Service, no refund will be made.
All refunds will be made via the original payment method unless otherwise agreed.
Article 7 (Confidentiality and Privacy)
The Company respects the privacy of Customers. The Company will not sell or disclose personal information of Customers to third parties without consent, except as required by law. All communications between Customers and the Company (email, facsimile, telephone, mail, etc.) will be treated as confidential and handled in accordance with the Company's Privacy Policy.
Article 8 (Prohibited Matters)
When using the Service, Customers shall not engage in any of the following acts:
- Acts that violate laws, regulations, or public order and morals.
- Criminal acts or acts related to crime.
- Acts that destroy or interfere with the Company's servers or network.
- Acts that interfere with the operation of the Service.
- Acts of impersonating another person.
- Acts of providing benefits directly or indirectly to antisocial forces in relation to the Service.
- Commercial use of images posted on this site without permission.
- Any other act deemed inappropriate by the Company.
Article 9 (Disclaimer and Limitation of Liability)
The Company shall not be liable for any default, except in cases of willful misconduct or gross negligence. To the maximum extent permitted by law, the Company's total liability arising out of or relating to the Service shall be limited to the amount paid by Customers for the Service.
The Company shall not be responsible for any transaction, communication, or dispute between Customers and other customers or third parties in relation to the Service.
Article 10 (Modification of Terms)
The Company may modify these Terms at any time. In such a case, the revised Terms shall be posted on the website and shall apply to all reservations made after the effective date of such modifications.

Article 12 (Prohibition of Transfer of Rights and Obligations)
Customers may not transfer or assign to a third party, or offer as collateral, their contractual position or any rights or obligations under these Terms without the prior written consent of the Company.
Article 13 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
